On March 30, 2025, Emmett was called home to eternal rest. He is predeceased by son, Jeffrey Peaks; parents, Emmett Smith, Sr. and Emily Smith; brother, Robert Smith; sisters, Geraldine Smith Williams, Helen Anderson, and Rosetta Pegues; father-in-law, Evon Tyree Peaks; mother-in-law, Eveyn Peaks; bothers-in-law, Don K. Peaks, Curtis Peaks, Sr., Mark Peaks, Godfrey "Pepper" Peaks, Douglas Battle, James A. Armstrong IV, Don Smith, and Ernest Stauton; sisters-in-law, Gloria Peaks, Bettie Peaks, and Demetrice Cross-Battle; nephew, Rodney Cross; and neice, Yolanda Peaks-Bell.

Loving memories of Emmett will be cherished forever by his wife of 63 years, Bernice Smith; son, Marvin Peaks; daughter, Cheryl (Charles Mylo) Simmons; granddaughter, Ciatonya Davis; grandson, Tyler Simmons; great grandchildren, Corey Evans, Jr., Chani Davis, Cimya Davis; Granddog, Grayson Simmons; brother, Richard Smith; sister, Bertha Nell Armstrong; brother-in-law, Braxton Anderson; sister-in-law, Teresa J.
